Terms of Service

The rules that apply when you use nestconcrete.com or work with us. Project-specific terms live in your signed agreement.

Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the website at nestconcrete.com (the “Site”) and any communications, quote requests, or services provided by Nest Construction & Concrete LLC (“Nest Concrete,” “we,” “our,” or “us”).

By accessing the Site, submitting a form, calling us, or otherwise engaging with us, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site or contact us through it.

Use of the Website

You may use the Site for lawful purposes related to evaluating, requesting, or coordinating concrete and related contracting services. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law
  • Attempt to gain unauthorized access to the Site, our servers, or any account or system associated with us
  • Use any automated system (bots, scrapers, harvesters) to extract data from the Site without our written permission
  • Submit false, misleading, or fraudulent information through any form, including impersonating another person or business
  • Introduce malware, viruses, or other malicious code to the Site
  • Use the Site or our brand assets to mislead, defame, or harm any person or business, including Nest Concrete

Estimates & Quotes

Information you submit through the contact form, quote form, or project quiz is a request for an estimate, not a binding order or commitment.

  • Initial pricing provided over phone, email, or based on photos is preliminary and subject to change after an on-site assessment.
  • Final estimates are provided in writing after our team reviews the site, scope, soil conditions, permitting requirements, and applicable code. Written estimates are valid for 30 days unless otherwise noted.
  • An estimate becomes a binding agreement only when both parties sign a project-specific written contract (see “Project Agreements” below).
  • Estimates assume normal site conditions. Hidden conditions discovered during work (unexpected soil, buried utilities, structural issues, code-required upgrades) may require change orders at additional cost, documented and approved in writing before any extra work is performed.

Project Agreements

Actual concrete, asphalt, or related contracting work is governed by a separate written project agreement signed by both you and an authorized Nest Concrete representative. That project agreement will contain the specific terms applicable to your project, including:

  • Scope of work, materials, and specifications
  • Total price, payment schedule, and deposit requirements
  • Project timeline and milestones
  • Permits, inspections, and code compliance responsibilities
  • Change-order procedures
  • Workmanship warranty terms specific to that project
  • Cancellation and refund terms
  • Insurance, lien rights, and dispute-resolution provisions

If anything in these Terms conflicts with your signed project agreement, the signed project agreement controls for that project.

Workmanship Warranty

Most Nest Concrete projects include a written workmanship warranty (typically 5 years) covering defects in installation. Specific warranty terms — including coverage, exclusions, transferability, and claims procedure — are stated in your signed project agreement and warranty certificate.

Warranties do not cover damage caused by acts of God (including hurricanes, flooding, sinkholes, or extreme weather), normal wear, neglect, owner modifications, third-party work, expansive soil movement outside our control, or use beyond the project's designed purpose.

Material warranties (concrete mix, asphalt mix, sealants, decorative finishes) are passed through from the manufacturer where applicable and are subject to those manufacturers' terms.

Reviews & Submissions

When you leave a review, send feedback, or submit content through the Site or our public Google / Yelp listings, you grant Nest Concrete a non-exclusive, worldwide, royalty-free license to display, reproduce, and quote that content on our website, marketing materials, and social channels, with attribution by first name and city (or by initials, if you request).

You represent that any content you submit:

  • Is your own original statement or accurate description of your experience
  • Does not violate the rights of any third party
  • Is not unlawful, defamatory, obscene, threatening, or harassing
  • Does not contain confidential information of any third party

We reserve the right to decline to publish, edit, or remove any submission at our sole discretion.

Intellectual Property

The Site and its content — including text, graphics, photos, logos, project case studies, video, and the “Nest Concrete” brand and trademarks — are owned by Nest Construction & Concrete LLC or licensed to us, and are protected by U.S. copyright, trademark, and other intellectual-property laws.

You may view, download, and print Site content for your personal, non-commercial use related to evaluating our services. You may not copy, reproduce, republish, modify, or distribute any Site content for commercial purposes without our prior written consent.

Third-Party Services

The Site links to and integrates with third-party services (FormSubmit, Cloudflare, Google services, Yelp, financing partners, suppliers, etc.). We are not responsible for the content, accuracy, availability, or practices of those third parties. Your use of any third-party service is subject to that service's own terms and privacy policies.

Disclaimers

The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Site content is provided for general informational purposes and does not constitute professional, legal, engineering, or licensed-contractor advice for any specific situation. Information about concrete techniques, costs, codes, or hurricane preparation is general guidance only — your project may differ, and specific recommendations require an on-site assessment by our team or another licensed professional.

We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Pricing displayed on the Site is illustrative and subject to change.

Limitation of Liability

To the maximum extent permitted by Florida law, Nest Concrete and its owners, officers, employees, subcontractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including but not limited to lost profits, lost data, business interruption, or loss of goodwill — even if we have been advised of the possibility of such damages.

Our total cumulative liability arising out of or related to your use of the Site (excluding signed project agreements, which have their own liability terms) shall not exceed one hundred U.S. dollars ($100).

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.

Indemnification

You agree to defend, indemnify, and hold harmless Nest Concrete, its owners, officers, employees, and subcontractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms, (b) your violation of any law or third-party right, or (c) any content you submit through the Site.

Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.

Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason — including violation of these Terms, abusive behavior toward our team, or fraudulent submissions. Termination of Site access does not affect rights or obligations under any signed project agreement.

Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the “Effective” date at the top of this page. Significant changes will be noted on the contact page. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
